These terms (the "Terms") govern the relationship between TierScope (the "Service", "we", "us") and an individual using the Service (the "User", "you"). The Terms constitute a public offer within the meaning of art. 437 of the Civil Code of the Russian Federation.

1. Acceptance of the Terms

The Terms are deemed accepted when the User performs any of the following actions:

  1. When registering with email and password, checks the required checkbox "I accept the Terms of Use and Privacy Policy" and completes registration.
  2. When signing in through a third-party identity provider (Google OAuth), clicks the provider sign-in button; below the button there is text stating: "By continuing with Google, you accept the Terms of Use and Privacy Policy."

The checkbox for email registration is not preselected and is not checked without an explicit User action. Registration without acceptance of the Terms is not possible.

At the moment of acceptance, the Service stores: account identifier, acceptance time (termsAcceptedAt), accepted Terms version (termsVersion), accepted Privacy Policy version (privacyVersion), IP address and user-agent. These records are evidence of acceptance; their retention period is specified in the Privacy Policy.

2. Subject matter

The Service provides the User with functionality to:

  • create public and private movie tier lists;
  • rate movies through swipe mode;
  • maintain a "Watch later" list (watchlist);
  • use likes, follows and other social actions between users;
  • view tier lists and profiles of other users according to their visibility settings.

The Service is provided free of charge "as is". The Service may introduce, change or discontinue individual features without prior notice.

3. Registration and account

3.1. The minimum User age is 14. For users from jurisdictions where the minimum age for independent consent is higher, consent or authorization from a person with parental responsibility is required.

3.2. The User must provide accurate information during registration. Using someone else's email address or impersonating another person is not allowed.

3.3. The User must keep account credentials secure and must not transfer them to third parties. The Service is not responsible for actions performed using the User's valid credentials.

3.4. One User may have one account. Creating additional accounts to bypass restrictions, such as blocks or limits, is not allowed.

4. Acceptable use

The User must not:

  • post content that violates the laws of the Russian Federation or another applicable jurisdiction;
  • post material containing propaganda of violence, hatred, discrimination on any grounds, extremism or calls for terrorism;
  • post sexually explicit content or any sexualized depiction of minors in any form;
  • post defamation, insults or threats against third parties;
  • post another person's personal data without a lawful basis;
  • infringe third-party intellectual property rights;
  • use the Service to distribute malware, phishing or spam;
  • perform automated data collection (scraping), except where expressly permitted by the Service;
  • take actions aimed at disrupting the Service, bypassing security systems, exploiting vulnerabilities or researching infrastructure without prior agreement;
  • create multiple accounts to manipulate social metrics, such as likes or follows;
  • use the Service for commercial purposes without a separate written agreement with the Service.

5. User content

5.1. Rights to content. The User retains all rights to content they create, such as tier lists, descriptions, ratings and comments.

5.2. License to the Service. By posting content in the Service, the User grants the Service a free, non-exclusive license to use that content to the extent necessary to:

  • store the content in the Service systems;
  • display the content to the User;
  • display public content to other Service visitors according to the visibility settings chosen by the User;
  • create technical backups;
  • moderate content, including removal and blocking.

The license is granted worldwide and for the period during which the content is posted in the Service. After the User deletes the content or account, the license ends; the only exceptions are de-identified backups and technical logs retained for the periods specified in the Privacy Policy.

5.3. Public status. By setting a tier list or profile to public, the User confirms that:

  • they understand that the content will become publicly available;
  • they agree that the content may be indexed by search engines and stored in their caches;
  • the Service does not control copies made by third parties after publication.

The legal regime for publicly available data is described in the Privacy Policy (section 6).

5.4. Responsibility for content. The User is responsible for the content they post. The Service does not pre-moderate user content and does not endorse it. Opinions expressed in user content are not the opinions of the Service.

6. Content complaints and removal

Any person may send a complaint to info@tierscope.ru about content posted in the Service that, in the complainant's view, violates these Terms or the law. The complaint should include:

  • a link to the specific content;
  • grounds for the complaint, including what rule is violated or what right is affected;
  • the complainant's contact details for feedback;
  • if the complaint concerns infringement of exclusive rights, confirmation of the complainant's rights.

The Service reviews complaints within a reasonable time and may, at its discretion, remove content, restrict its visibility, block the violator's account or reject the complaint. Service decisions on complaints are not final legal acts; the parties may use other remedies provided by law.

The Service may also remove content on its own initiative if it clearly violates section 4 of the Terms.

7. Account deletion and data export

7.1. The User may delete the account at any time through profile settings. During deletion, the User is offered a choice for public content: full deletion or anonymization, where the content remains but the link to the account is removed.

7.2. The User may request a data export in machine-readable JSON format, including account content, tier lists, ratings, likes and follows. Export is available in the account area or by request to info@tierscope.ru.

7.3. Details of the deletion process, including backups and logs, are described in the Privacy Policy (sections 4 and 8).

8. Termination by the Service

The Service may restrict access to, block or delete an account in case of: material or repeated violation of the Terms; reasonable suspicion of unlawful activity; a request from competent authorities; or discontinuation of the Service.

If an account is blocked, the User is notified by email with the reason and, where possible, given an opportunity to export data before final deletion.

9. Movie data and third-party services

9.1. Movie metadata, such as titles, posters, descriptions and ratings, is provided by The Movie Database (TMDB). The Service is not endorsed or certified by TMDB (this product uses the TMDB API but is not endorsed or certified by TMDB).

9.2. Availability, accuracy and relevance of metadata are determined by TMDB. The Service is not responsible for the content of metadata provided by TMDB.

9.3. The list of other third parties used by the Service and the data transfer regime are described in the Privacy Policy (section 5).

10. Intellectual property of the Service

The design, frontend and backend source code, trade name "TierScope", logos, graphic elements, documentation texts and other elements of the Service that are not user content or TMDB metadata belong to the Service rights holder. Use of these elements beyond ordinary use of the Service is allowed only with the rights holder's permission.

11. Limitation of liability

11.1. The Service is provided "as is" without any express or implied warranties to the maximum extent permitted by applicable law.

11.2. The Service does not guarantee uninterrupted operation, preservation of all data under all circumstances, fitness for the User's specific purposes or absence of errors.

11.3. To the extent permitted by applicable law, the Service is not liable for indirect losses, lost profits, data loss, reputational harm, harm caused by actions of other users, harm caused by failures of third-party services (Google, Yandex, TMDB, hosting or communication providers) or harm caused by force majeure events.

11.4. If applicable law does not allow limitation or exclusion of liability for specific categories, the Service's liability is limited to the minimum permitted by that law.

12. Changes to the Terms

12.1. The Service may update the Terms. Material changes are published with a new effective date and version in the document header.

12.2. The User is notified of material changes by one or more of the following methods: an in-Service notice at the next sign-in or an email to the account address.

12.3. Continued use of the Service after the updated version takes effect constitutes acceptance of the updated version. If the User does not agree with the changes, the User may delete the account before the new version takes effect.

12.4. Non-material edits, such as wording clarifications, typo fixes or technical clarifications, apply from the moment of publication without separate notice.

13. Governing law and dispute resolution

13.1. The Terms are governed by the law of the Russian Federation.

13.2. Disputes arising from the Terms are resolved through negotiations. A pre-trial claim procedure is mandatory: a claim must be sent to info@tierscope.ru, and the response period is 30 calendar days.

13.3. If no agreement is reached, the dispute is submitted to the competent court determined under the laws of the Russian Federation.

13.4. Clause 13.1 does not deprive a consumer User from the EEA, the United Kingdom or another jurisdiction with mandatory consumer protection rules of the right to protection under the law applicable to that User.

14. Final provisions

14.1. If any provision of the Terms is found invalid, the remaining provisions remain in force.

14.2. Failure by the Service to exercise any right does not constitute a waiver of that right.

14.3. The Terms are drafted in Russian. Translations into other languages, if provided, are for convenience; in case of discrepancies, the Russian version prevails.
